Terms and Conditions
Last Updated: January 2025
Welcome to Cisneros Prosperity Tax Services (“CPTax Services”). By using our website, scheduling services, or engaging with our virtual team, you agree to the following Terms and Conditions. Please read them carefully, as they outline your responsibilities and our service standards.
1. Accuracy and Validity of Information
By using the services of CPTax Services, you agree to provide true, complete, and accurate information at all times. Any errors or omissions in the information you provide may affect the accuracy of your tax return or bookkeeping reports. CPTax Services is not responsible for delays, penalties, or inaccuracies resulting from incomplete or incorrect information provided by you. You are responsible for reviewing all returns and documents prior to final submission or e-filing.
2. Availability
Our services are provided virtually through secure online platforms. While we strive to maintain continuous availability of our website, client portal, and communication tools, CPTax Services cannot guarantee uninterrupted access due to maintenance, technical issues, or other circumstances beyond our control. We are not liable for temporary service interruptions, data transmission delays, or any loss arising from factors outside our reasonable control.
In the event of planned system maintenance, we will make reasonable efforts to notify clients in advance and minimize any disruption to service.
3. Third-Party Websites
Our website or communications may include links to third-party platforms, such as secure document upload portals or payment processors. These links are provided for your convenience only. CPTax Services does not control and is not responsible for the content, policies, or security practices of third-party websites. Your use of those sites is governed by their own terms and privacy policies, and we encourage you to review them carefully before providing any personal information.
4. Copyright and Intellectual Property
All content on this website—including text, graphics, logos, and other materials—is the property of CPTax Services unless otherwise stated. You may not copy, distribute, reproduce, or modify any part of this website or its materials without prior written consent. Use of our name, logo, or branded materials for commercial purposes is strictly prohibited.
- You may download or print materials for personal, non-commercial use only.
- You may share links to our content if properly credited to CPTax Services.
- Unauthorized reproduction or distribution may result in legal action.
5. Termination of Services
CPTax Services reserves the right to refuse, suspend, or terminate services at any time if a client fails to comply with these Terms and Conditions, provides false information, engages in abusive or fraudulent behavior, or otherwise compromises the integrity or security of our systems. Clients may also terminate services at any time prior to e-filing or completion of deliverables, subject to applicable payment terms.
Upon termination, any outstanding balances must be paid in full, and access to the client portal may be restricted once services are completed.
6. Limitation of Liability
To the maximum extent permitted by law, CPTax Services, its owners, and contractors shall not be liable for any direct, indirect, incidental, or consequential damages arising from the use or inability to use our services or website. This includes, but is not limited to, loss of income, data, or reputation. Our liability is limited solely to the amount paid for services rendered.
CPTax Services operates in good faith and in compliance with IRS Circular 230 and other applicable laws. Clients are responsible for timely providing accurate information and reviewing all completed returns before submission.
7. Payment Terms
All service fees for CPTax Services must be paid in full before any tax return is filed or financial documents are delivered. We accept payments through secure online methods only. Pricing is based on the complexity of the return or service requested and will be discussed with each client before work begins.
Invoices are due upon receipt unless otherwise stated in writing. Work may be paused or delayed if payment has not been received. In the event of nonpayment, CPTax Services reserves the right to withhold completed returns, reports, or supporting documentation until the balance is satisfied in full.
Returned or disputed payments may result in additional processing fees. Repeated nonpayment or chargebacks will result in immediate termination of services and potential collection action.
By engaging our services, you acknowledge and agree to these payment terms and understand that electronic payments are processed through secure third-party systems for your protection.
8. No Refund Policy
All payments made to CPTax Services are final. Because our work involves professional time, expertise, and the preparation of confidential tax and financial documents, we do not offer refunds once services have begun or documents have been submitted for review or filing. This policy applies to all services, including but not limited to tax preparation, bookkeeping, and consulting.
If you believe an error occurred in the delivery of your service, please contact us immediately at [email protected] so we can review your concern and make corrections if appropriate. Corrections or adjustments do not constitute a refund.
By engaging our services, you acknowledge and agree to this No Refund Policy and understand that fees are due regardless of filing outcomes or tax liabilities.
9. Service Completion
Services provided by CPTax Services are considered complete once the agreed-upon deliverables have been finalized and delivered to the client. For tax preparation, this means the return has been filed electronically with the IRS and/or applicable state agencies, or provided to the client for signature and submission. For bookkeeping or consulting services, completion occurs when the reports, reconciliations, or recommendations have been delivered as outlined in the service agreement or invoice.
Any revisions, updates, or additional work requested after completion will be treated as a new engagement and billed accordingly. This includes amended tax returns, updated reports, or additional consultations requested after final delivery.
CPTax Services is not responsible for post-filing changes to client circumstances, IRS or state agency processing times, or any actions taken by the client after services are completed.
By using our services, you acknowledge and agree that once a service is completed as defined above, no further changes or obligations remain unless a new engagement is initiated.
10. Governing Law & Agreement
These Terms and Conditions are governed by and interpreted in accordance with the laws of the State of Maryland, without regard to its conflict of law principles. By accessing this website or engaging the services of CPTax Services, you agree that any dispute or claim arising from or related to these terms, our services, or your use of this website shall be resolved exclusively in the appropriate state or federal courts located within Maryland.
If any provision of these Terms and Conditions is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. Failure by CPTax Services to enforce any right or provision in these terms does not constitute a waiver of such right or provision.
By continuing to use this website or our services, you acknowledge that you have read, understood, and agreed to all of the above Terms and Conditions. If you do not agree to these terms, please discontinue use of our website and services immediately.
For questions or concerns regarding these Terms and Conditions, please contact us at [email protected] or call (443) 299-5070.
